Terms of Use

1. Acceptance of Terms

By accessing or using AdventureDucks.net (the "Site"), you agree to be bound by these Terms of Use. If you do not agree, you may not use the Site. These Terms are entered into between you ("User") and Squeaky Squirrel LLC, a Rhode Island limited liability company ("Company," "we," "us," or "our").

2. Eligibility

The Site is intended for general audiences. However, Adventure Ducks are not toys for children under the age of three (3) due to small parts that may pose a choking hazard. By using the Site, you represent that you are either (a) at least 13 years old, or (b) using the Site with the consent and supervision of a parent or guardian.

3. Nature of Service

AdventureDucks.net provides a platform for users to log, share, and follow the journeys of Adventure Ducks. This includes allowing users to enter names, manually entered locations, notes/messages, and photos about their duck findings.

4. User Content

Users may submit names, notes, messages, and photos ("User Content") when logging or following ducks.

You are solely responsible for any User Content you submit.

You agree not to post content that is unlawful, offensive, inappropriate, infringing, or otherwise harmful. This includes photos that contain nudity, violence, copyrighted materials without permission, or personal information of others without their consent.

Although AdventureDucks.net is designed to be family-friendly, we cannot guarantee that all User Content will be appropriate for children.

By submitting User Content, including photos, you grant Squeaky Squirrel LLC a non-exclusive, worldwide, royalty-free, perpetual license to display, distribute, reproduce, modify, and otherwise use such content in connection with the Site, social media accounts, and promotional activities.

You retain ownership of your User Content. This license is solely for purposes of operating and promoting AdventureDucks.net.

We reserve the right, but not the obligation, to moderate, remove, or modify any User Content at our sole discretion.

5. Purchases

At present, purchases of Adventure Ducks are facilitated through Etsy and are subject to Etsy's own terms, conditions, and refund policies.

When purchases become available directly through AdventureDucks.net, they will be subject to refund and return terms provided at the time of purchase.

6. SMS / Text Message Program

If you opt in to receive SMS text message notifications from Squeaky Squirrel LLC (Adventure Ducks) (for example, alerts about ducks you follow or nearby duck drops):

  • Consent to receive SMS messages is not a condition of any purchase.
  • Message frequency varies based on your activity and the alerts you subscribe to.
  • Message and data rates may apply.
  • You may opt out at any time by replying STOP to any message, or by disabling SMS notifications in your account settings.
  • Reply HELP for help, or contact us at Help@SqueakySquirrel.com.
  • Carriers are not liable for delayed or undelivered messages.

7. Disclaimers

Adventure Ducks are provided for entertainment purposes only.

We make no warranties regarding uninterrupted or error-free operation of the Site.

Squeaky Squirrel LLC shall not be liable for any injury, loss, or damage resulting from the use or misuse of Adventure Ducks or the Site.

8. Governing Law

These Terms are governed by and construed under the laws of the State of Rhode Island, without regard to its conflict of law principles.

Privacy Policy

1. Information We Collect

We may collect the following information when you interact with the Site:

  • Finder Information: The name you provide when logging a duck.
  • Email Address: If you choose to follow a duck's journey, we collect your email to send updates.
  • Mobile Phone Number: If you choose to opt in to SMS text notifications, we collect your mobile phone number to send you the alerts you've requested (for example, updates on ducks you follow or nearby duck drop alerts).
  • Location Information: A manually entered location you provide when logging a duck (we do not use GPS or automated geolocation).
  • Messages/Notes/Photos: Any content you submit when logging a duck.

2. How We Use Information

We use the information collected to:

  • Facilitate the logging and sharing of Adventure Duck journeys.
  • Provide email updates if you choose to follow a duck.
  • Send SMS text message alerts, if you have opted in, about duck activity you've subscribed to (message frequency varies; message and data rates may apply).
  • Maintain and improve the Site.
  • Promote AdventureDucks.net (including through use of submitted photos and content on social media, in accordance with the license granted in these Terms).
  • Ensure community safety and compliance with these Terms.

3. Data Sharing

We do not sell your personal information.

We may share data with trusted third-party service providers solely to operate the Site (e.g., hosting providers, email delivery services, and our SMS delivery provider, used only to send the text messages you've opted into).

We do not share or sell your mobile phone number to third parties or affiliates for marketing purposes. Your phone number is used solely to deliver the SMS notifications you have requested.

4. SMS / Text Messaging

If you opt in to SMS notifications:

  • Message frequency varies depending on the ducks and alerts you subscribe to — there is no fixed schedule.
  • Message and data rates may apply, depending on your mobile carrier and plan.
  • You can opt out at any time by replying STOP to any message, or by turning off SMS notifications in your account settings.
  • Reply HELP for assistance, or contact us at Help@SqueakySquirrel.com.
  • Your phone number is never shared with third parties or affiliates for marketing purposes; it is used only to deliver the SMS alerts you've requested.

5. Data Retention

We retain submitted data as long as necessary to provide the services described. You may contact us to request deletion of your email, phone number, or other personal data.

6. Security

We take reasonable technical and organizational measures to protect your information. However, no method of online transmission or storage is completely secure.

7. Children's Privacy

We do not knowingly collect personal information from children under the age of 13 without parental consent. If we learn that we have collected such information, we will promptly delete it.

8. User Content

Content submitted to the Site (e.g., names, notes, photos) may be publicly visible as part of a duck's travel history. Please do not share sensitive personal information in these submissions.
